These Terms & Conditions ("Terms") govern your access to and use of the cloud VPS hosting services provided by CloudZenixes ("CloudZenixes", "we", "us", or "our") through https://cloudzenixes.com. By registering for an account, placing an order, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By creating an account or purchasing a service, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and that you have the authority to enter into these Terms on behalf of yourself or the entity you represent.

2. Description of Service

CloudZenixes provides a range of cloud infrastructure services, including Cloud VPS (shared), Dedicated VDS, Confidential Computing (SEV-SNP with full-disk encryption), and Proxy services (datacenter, residential, rotating, and ISP). Services are available across seven global locations (United States, Canada, United Kingdom, France, Germany, Netherlands, and Singapore), with a choice of operating systems including Windows (accessed via RDP) and Linux/BSD distributions. Our services are delivered electronically. Specific resources (CPU, RAM, storage, and bandwidth) are as described on the applicable product or plan page at the time of purchase.

3. Account Registration & Security

You are responsible for providing accurate registration information and for keeping it up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@cloudzenixes.com of any unauthorised use.

4. Acceptable Use

You agree not to use our services to host, store, transmit, or distribute any content or to engage in any activity that:

  • violates any applicable law or regulation;
  • infringes the intellectual property or privacy rights of others;
  • involves spam, phishing, malware, or other malicious or fraudulent activity;
  • constitutes unauthorised cryptocurrency mining or otherwise abuses shared resources;
  • disrupts, degrades, or places an unreasonable load on our infrastructure or network; or
  • attempts to gain unauthorised access to any system, network, or data.

We reserve the right to determine, in our reasonable discretion, what constitutes a violation of this Acceptable Use section.

5. Payment Terms

Services are billed in advance on a recurring basis for the plan and billing cycle you select. Prices are displayed in the applicable currency (USD or INR). Payments are processed securely through our third-party payment provider, PayU. You are responsible for all applicable taxes. Failure to pay by the due date may result in suspension or termination of your services.

6. Suspension & Termination

We may suspend or terminate your services, with or without notice, if you breach these Terms, fail to make payment when due, or engage in activity that harms CloudZenixes, our other customers, or third parties. You may cancel your services at any time in accordance with our Refund & Cancellation Policy.

7. Service Availability

We target a monthly uptime of 99.9%. However, services are provided on an "as available" basis and we do not guarantee uninterrupted or error-free operation. Scheduled maintenance, factors beyond our reasonable control, and events of force majeure may affect availability.

8. Limitation of Liability

To the maximum extent permitted by law, CloudZenixes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or in connection with your use of our services. Our total aggregate liability shall not exceed the amount you paid to us for the service in the one (1) month preceding the event giving rise to the claim.

9. Indemnity

You agree to indemnify and hold harmless CloudZenixes and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the services or your breach of these Terms.

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, India.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the services after changes take effect constitutes acceptance of the revised Terms.
